1. Introduction

Thank you for visiting the BuildBoard application, available at https://app.buildboard.gr/ (hereinafter referred to as "BuildBoard" or "application" or "platform"). The company under the name "Resolute Cepal Greece S.A." (hereinafter: "RCG", "Company", "we", "our" or "us"), having its registered office at 8 Xenofontos Street, Athens, PC 10557, has developed and manages the application.

The purpose of this document is to disclose the Terms of Use that govern the use of the BuildBoard application. The use of the application and the services provided, as well as your browsing in general, are determined and governed by the following provisions and terms (hereinafter the "Terms of Use").

Before using the app, please read carefully and ensure that you understand and agree to such provisions, rules, and statements, as your continued use of the app and your navigation through it implies your express and unconditional acceptance and agreement.

2. Definitions

  • Company:The company under the name "Resolute Cepal Greece S.A." (RCG), having its registered office at 8 Xenofontos Street, Athens, PC 10557.
  • User: Any natural or legal person who has been registered with the application and uses the services provided through it.
  • Subscription Plan (Package): The package of services that a User selects and subscribes to in order to access the application and its features.
  • Geographical Coverage: The areas of Greece that are covered by the application and the services provided through it, as determined by the selected Subscription Plan.
  • BuildBoard: The web application/platform developed and managed by RCG, available at https://app.buildboard.gr/.
  • Features: The individual features and functions available within the application, the scope of which may vary depending on the selected Subscription Plan.

3. Our Services

BuildBoard is an online platform that collects and aggregates real estate information, providing access to registered Users through a set of built-in features. These features include the ability to track new-build progress, manage assignments, perform contact actions, and store relevant information.

The scope of information and features available to each User depends on their selected Subscription Plan. Access to specific geographical areas, data sets, and platform functionalities may vary accordingly.

4. User Registration and Login

4.1 Sign-up Process

In order to register with the application, the User must contact RCG, select an appropriate Subscription Plan, and receive the necessary credentials to access the platform.

4.2 Sign-in Process

Users may sign in to the application using their credentials, or alternatively through Microsoft or Google authentication services.

4.3 Registration Requirements

The User must be an adult, i.e. at least 18 years of age, in order to register with and use the application.

4.4 Account Security

The User is solely responsible for maintaining the confidentiality and security of their login credentials. The User must immediately notify the Company in the event of any unauthorized use of their account or any other security breach. The Company shall not be liable for any loss or damage arising from the User's failure to comply with these security obligations.

5. Financial Terms

In order to access the application and its services, the User must purchase a Subscription Plan from RCG. The details, pricing, and terms of each Subscription Plan are communicated to the User during the registration process.

The Company reserves the right to modify the pricing and terms of the Subscription Plans at any time. Any such changes shall not apply retroactively and will take effect only upon the renewal of the User's current Subscription Plan.

6. Restriction, Suspension and Termination

The Company reserves the right to restrict, suspend, or terminate a User's account at its sole discretion, for any of the following reasons:

  • The account has been dormant for a period exceeding two (2) years.
  • The User has violated these Terms of Use.
  • The User has engaged in fraudulent or unlawful activity.

In the event of account termination, the Company shall provide the User with at least three (3) working days advance notice, unless the termination is due to a serious violation of these Terms of Use or applicable law.

The User may at any time request the deletion of their account by contacting the Company through the communication channels provided in Section 18 of these Terms of Use.

7. User Obligations

The User is obligated to keep their email address and other contact information up to date at all times. The User must use the application and its services solely for lawful purposes and in accordance with these Terms of Use and all applicable laws and regulations.

8. Prohibited Uses

The User is expressly prohibited from:

  • Using the application for any unlawful or unauthorized purpose.
  • Attempting to gain unauthorized access to the application, its servers, or any related systems or networks.
  • Processing or disclosing personal data of third parties obtained through the application without their explicit consent or any other legal basis.
  • Uploading, transmitting, or distributing any harmful, offensive, or inappropriate content.
  • Infringing the intellectual property rights of the Company, other Users, or any third party.
  • Introducing viruses, malware, or any other harmful code or technology that may damage or interfere with the operation of the application or the devices of other Users.

9. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use or inability to use the application or its services.

The information provided through the application is for informational purposes only and does not constitute professional, legal, financial, or any other type of advice. The User acknowledges that any reliance on such information is at their own risk.

The application and its services are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Other Terms

The Company does not guarantee uninterrupted, continuous, or error-free access to the application or its services. Access may be temporarily interrupted for maintenance, updates, or other technical reasons. The Company shall not be liable for any loss or inconvenience caused by such interruptions.

11. Personal Data

The personal data of Users is collected and processed in accordance with the Company's Data Protection Policy. For detailed information about the processing of your personal data, please refer to our Data Protection Policy.

12. Cookies

The application may use cookies and similar technologies to enhance the User experience and for analytical purposes. For detailed information about the cookies we use, please refer to our Cookies Policy.

13. Intellectual Property

All content, trademarks, logos, designs, texts, graphics, images, software, and other materials displayed on or available through the application are the property of BuildBoard/RCG or its licensors and are protected by applicable intellectual property laws.

The User retains all intellectual property rights in any content they upload or submit through the application. However, by uploading or submitting such content, the User grants the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purposes of operating and improving the application.

The User warrants that they are the owner of or have the necessary rights and permissions to upload or submit any content through the application, and that such content does not infringe the intellectual property rights of any third party.

Any third-party content displayed on the application is subject to the respective third party's terms and conditions and intellectual property rights.

14. Force Majeure

The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms of Use to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, epidemics, pandemics, government actions, power failures, internet or telecommunications failures, or any other force majeure event.

15. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Greece. Any disputes arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the competent courts of Athens, Greece.

16. Change of Terms

The Company reserves the right to revise, amend, or update these Terms of Use at any time. In the event of any material changes, the Company shall provide Users with at least fifteen (15) days advance notice before the changes take effect. Continued use of the application after the effective date of the revised Terms of Use constitutes acceptance of the updated terms.

17. Application - Autonomy

These Terms of Use constitute the final and binding agreement between the User and the Company regarding the use of the application and its services. If any provision of these Terms of Use is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
